Terms and conditions of sale

1. Purpose
These General Terms and Conditions of Sale (GTC) apply to all recreational diving services offered by Le Bateau Jaune and its affiliated structures (13 Aquatic and Sensations Bleues), hereinafter referred to as "the Provider", to any customer, whether a natural or legal person, hereinafter referred to as "the Customer".
All orders imply the Client's full and unreserved acceptance of these terms and conditions.
General terms and conditions apply, unless otherwise agreed in writing between the parties.
2. Nature of services
The Provider designs, organizes and delivers professional training in the field of underwater activities.
Training courses can be conducted:
• in person, at the premises of the Provider or the Client; ;
• in a natural environment (on suitable diving sites); ;
• or remotely, via videoconference or e-learning.
3. Registration procedures
Registration becomes firm and final upon receipt:
• of the signed training agreement; ;
• and the payment of the deposit mentioned in the quote.
The Provider reserves the right to refuse any registration not accompanied by the required documents or regulations.
4. Prices and payment terms
Training fees are indicated in euros inclusive of all taxes, in accordance with the regulations applicable to professional training.
Unless otherwise stated, prices include:
• educational activities,
• the provision of teaching materials,
• and training materials.
Not included: meals, accommodation, travel, personal equipment costs
(e.g., diving equipment).
 
Payment methods:
• 30 % upon registration (deposit),
• the balance at the end of the training, upon receipt of the invoice.
Payments can be made by bank transfer, check, or any other agreed method.
5. Coverage by an OPCO or other funding body
When the training is financed by an OPCO, France Travail, or any other organization, it is the Client's responsibility to make the request for coverage before the start of the training and to provide the corresponding certificate.
In the event of refusal or non-payment by the funder, the Client remains liable for the full cost of the training.
6. Conditions for cancellation, postponement or absence
Cancellation by the Customer:
• More than 30 days before the training: no charge.
• Between 15 and 30 days: 30 % of the total amount will be invoiced.
• Less than 15 days: 100 % of the total amount is due.
Cancellation by the Service Provider:
The Provider reserves the right to cancel or postpone a session for educational, weather, logistical or safety reasons (particularly for training in natural environments).
In this case, the sums paid will be fully refunded or transferred to another session, without additional compensation.
Trainee abandonment or absence:
Any training course that has begun is due in full, except in cases of duly justified force majeure.
7. Obligations and responsibilities of the Service Provider
The Service Provider agrees to:
• deliver a service in accordance with the agreed program,
• ensure the safety and educational quality of the training,
• provide a qualified and recognized trainer in the relevant field.
 
The Service Provider is subject to an obligation of means and not of result.
It cannot be held liable for any indirect, tangible or intangible damage (loss of profits, data, etc.).
8. Client/Intern Obligations
The intern agrees to:
• Follow safety instructions, especially in aquatic environments,
• To adopt respectful behavior in accordance with the internal regulations.,
• provide the necessary documents (medical certificate, parental authorizations,
etc.),
• Be up-to-date with your civil liability insurance.
9. Intellectual Property
All training materials (documents, videos, exercises, etc.) provided or made available are the exclusive property of the Provider.
Any reproduction, distribution or use without written permission is strictly prohibited.
10. Protection of personal data (GDPR)
The data collected is strictly necessary for the administrative and educational management of the training courses.
They are neither transferred nor sold.
In accordance with the French Data Protection Act and the GDPR, the Client has the right to access, rectify and delete their data upon simple request to: rgpd@sensations-bleues.com.
Dispute resolution
Any dispute relating to the execution or interpretation of these Terms and Conditions shall, in the absence of an amicable agreement, be submitted to the competent courts of the jurisdiction of the registered office of
Provider.
11. General Provisions
These Terms and Conditions may be modified at any time by the Service Provider.
The applicable version is the one in effect on the date of signature of the quote or agreement.

General terms and conditions of online sale

ARTICLE 1 - PURPOSE
Billetweb is a ticketing solution (hereinafter referred to as "the Ticketing Service") published by Trustweb (hereinafter referred to as "the Company"). This Ticketing Service allows event organizers (hereinafter referred to as "the Organizers") of events (hereinafter referred to as "the Events") to sell their tickets (hereinafter referred to as "the Tickets") on the website www.billetweb.fr (hereinafter referred to as "the Site"). Purchasers of these tickets are hereinafter referred to as "the Buyers." Holders and users of the tickets are referred to as "the Participants.".
These terms and conditions apply to all ticket purchases made through the Ticketing Service. Billetweb acts as an intermediary during the sales process but is never involved in the organization of the event. The Organizers are therefore fully responsible for the event's execution. These terms and conditions do not cover the event itself. The Organizers may add their own terms and conditions regarding the event itself in a separate document that will be provided to you after this document.
ARTICLE 2 – RATES
Ticket prices include the currency, as required by current regulations. Unless otherwise stated, prices shown on the ticketing website are inclusive of all taxes.
As the organizers have the right to modify the various prices during the sales period, the invoicing, carried out by the company, is based on the prices in effect at the time the said order was created by the participant.
ARTICLE 3 – AVAILABILITY
The ticketing system informs you in real time about product availability as you place your order. If any tickets become unavailable between the start and end of your order, the system will notify you. You will be able to review the contents of your order before confirming and paying.
ARTICLE 4 – PLACEMENT
Unless otherwise stated during booking and on the ticket, seating is unassigned. If the Organizer has chosen to implement a seating system, you will be asked to select your seat or section during the booking process. Locations shown on maps or diagrams are for illustrative purposes only. They are intended to be as representative as possible but are not contractually binding.
ARTICLE 5 – PERSONAL DATA
In accordance with Law No. 78-17 of 6 January 1978, relating to Information Technology, Files and Freedoms, the processing of your information is subject to a declaration to the National Commission for Information Technology and Freedoms (CNIL) under declaration number 1759026.
You have a permanent right to access and rectify all data concerning you, in accordance with European regulations and applicable national laws. Simply send your request by email (contact@Billetweb.fr).
When placing your order, you will be required to provide personal information about your identity as well as that of the Participants.
The information required for the Ticket Office to process your order is: the Buyer's first and last name and email address. This information may also be used by Billetweb to contact you if there is a problem with your order.
Other information may be collected at the Organizer's request, particularly in the event of a postponement or cancellation of the Event. The Company collects this data on behalf of the Organizer and informs them of it. The Organizer is then responsible for the proper storage and use of the data to which they have had access. Our system hosts the data for a period of 1 to 3 years following the end of the event (this parameter is defined by the organizer). After this period, the data is anonymized.
By accepting these General Terms and Conditions of Sale, you expressly authorize the Company to transmit your personal data to the Event Organizer. The Company cannot be held liable for any use that may be made of this data. The Organizer is solely responsible for the management and content it sends to the Participant.
If you create or use a buyer account to place an order, you authorize Billetweb to collect, store, and process your data. When you make a subsequent booking using this account, you authorize Billetweb to share some of your data with the organizer for whom you are placing that order. This data is retained for three years from the date of the buyer's last purchase.
ARTICLE 6 – PAYMENT
Confirming your order implies your obligation to pay the indicated price. Only one payment method is permitted per order.
You can pay for your order by credit card (Carte Bleue, VISA, EUROCARD, or MASTERCARD). Payment is processed by our banking partner. Their contact information is available on the "Legal Notice" page of the website www.billetweb.fr. Card payments may use the 3D Secure system, which aims to identify the cardholder in order to limit fraud.
Once the transaction is validated by the bank, your bank account will be debited with the order amount. Following the transaction, an order confirmation will be sent to you by email. You will be able to download an invoice from this email.
In the event that a payment is invalidated by the bank after your ticket or order has been issued, it will be invalidated, preventing you from accessing the event. All transactions with the billetweb.fr website are secured by SSL encryption. The buyer's bank details are not stored by our system. Online electronic payments are processed on the Billetweb website or directly on the website of the company's banking partner, which ensures their security using appropriate encryption and authentication technologies.
ARTICLE 7 – ORDER CONFIRMATION
Once your order is paid, a confirmation message will appear. An order confirmation email containing your tickets will be sent immediately. It is then your responsibility to verify receipt of the tickets. Please note that some courier providers may delay ticket delivery. If you have not received your tickets after several hours, please contact the organizer or Billetweb customer service. You can check payment status or resend tickets from the ticketing system. Failure to receive your order does not invalidate it.
ARTICLE 8 – ISSUANCE AND CONDITIONS OF USE OF TICKETS
Delivery
Electronic tickets or a link to download them are sent to the Buyer's email address after each order.
Features
In accordance with regulations, each Ticket includes the following information, either in visible or coded form:
– Organizer Identification
– Event Name
– Tariff name
– Price paid by the buyer
– Unique ticket and order identification number
Support
To be accepted, the ticket must be printed in black and white or color on blank, white A4 paper. It must be completely intact and legible: damaged or illegible tickets will not be considered valid.
Presenting a ticket on a digital device (tablet, smartphone) will only be accepted if expressly stated by the organizer in the ticket's instructions. The participant remains responsible for being able to present the ticket on the digital device at the event entrance. Billetweb accepts no liability for any issues that may arise during the ordering, downloading, or printing of a ticket. No duplicates will be issued other than the original ticket.
Uniqueness
A ticket can only be used once to access the event. Therefore, in case of loss, theft, or duplication, only the first person to present the ticket will be admitted to the event. A ticket holder whose ticket has already been used will not be entitled to any refund.
The ticket is valid only for the venue, date, and time to which it pertains. The ticket must be kept until the end of the event. The ticket may be nominative, depending on the settings configured by the organizers on the ticketing system. In this case, in addition to the purchaser's identity, the recipient's identity will be indicated on the ticket. Nominative tickets remain personal and non-transferable, except with the express prior authorization of the organizers.
The ticket is unique, comprising an identification number and a barcode. Reproduction, duplication, or counterfeiting of tickets is prohibited. The organizers reserve the right to refuse entry to the event venue. No refunds will be issued in such cases.
Control
The Organizer is free to check the validity of Tickets upon entry to the event. They are not required to verify the identity of the Ticket holder, as each Ticket has a unique and unpredictable identifier. Therefore, Participants must ensure the confidentiality of their Tickets. Entry to the Event may be refused to any Participant presenting a previously used Ticket. The Organizer is not obligated to verify the authenticity of the ticket.
Proof
The Organizer also reserves the right to verify the identity of participants. If Tickets are registered to a specific name, the Participant must be able to provide proof of identity with an official document including a photograph. The Organizer may request additional documentation upon entry to the event. This information will be provided to the Participant via the order confirmation email and through instructions printed on the Ticket.
ARTICLE 9 – REFUND
No right of withdrawal
According to the provisions of Article L121-20-4 of the French Consumer Code, tickets are non-refundable and cannot be cancelled. All orders are therefore legally considered firm and final. Tickets cannot be refunded, even in case of loss or theft, nor can they be returned or exchanged. Only two cases can result in a refund:
– The event is cancelled or substantially modified
– The organizer authorizes the refund and makes the funds available for the refund
Refunds will only be issued to the original purchaser. No fees of any kind will be refunded or compensated. Any decision to cancel, postpone, or modify an event is the sole responsibility of the Organizer.
ARTICLE – 10 CUSTOMER SERVICE
For any questions the Buyer may have regarding the event or access conditions, the Participant should contact the Organizer, whose contact information can be found on the Ticket sales page. If the request cannot be fulfilled, the Organizer will contact Billetweb. For any technical questions related to ticketing or sales, the Participant can contact Billetweb using the methods available on the Billetweb website.
In the event of a dispute or default by the event organizer, the buyer must contact Billetweb.
If the consumer has filed a complaint with Billetweb and has not received a satisfactory response or any resolution within two months, the buyer may contact our mediator, MCP Médiation, in accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes. ARTICLE 11 – APPLICABLE LAW
French law shall apply, regardless of where the Event is held. Any dispute relating to the interpretation or performance of this contract shall be subject to the jurisdiction of the courts of Paris, regardless of the location of performance of this agreement or the defendant's domicile.
In accordance with Article L121-20-3 of the French Consumer Code, Billetweb is fully liable to the consumer for the proper performance of the obligations arising from the distance contract. Billetweb is therefore responsible for the transmission of the ticket. However, Billetweb cannot be held responsible for the conduct of the Event and for
the execution of the Organizer's obligations during the event. As the event takes place under the sole responsibility of the Organizer, Billetweb cannot be held liable for reasons such as cancellation, postponement, modification of the event or any other incident that may occur during the event.
ARTICLE 12 – ACCEPTANCE OF GENERAL TERMS AND CONDITIONS
The user declares having read and accepted these General Terms and Conditions of Sale, as well as any additional terms and conditions that may have been attached by the Organizer concerning the organization of the event. The connection and transaction data stored by Billetweb constitutes proof thereof.
